You must be at least 13 years old to use the Services independently. Children under 13 may use the Services only through a parent, legal guardian, or authorized school and after any required consent has been obtained. A parent or guardian who authorizes a minor to use the Services is responsible for the minor’s use and compliance with these Terms.
You must provide accurate information, protect login credentials, and promptly notify SMA of suspected unauthorized access. Accounts are personal and may not be shared. Parents and guardians may access only information for students they are authorized to represent. SMA may suspend or restrict access to protect students, records, systems, or program integrity.
Students must comply with applicable enrollment terms, academic policies, syllabi, attendance requirements, deadlines, prerequisite rules, grading standards, academic-integrity rules, technology requirements, and instructor directions. Enrollment does not guarantee course completion, a passing grade, credit, a diploma, or another academic result.
SMA may reasonably update course materials, schedules, instructors, technology, or delivery methods and may cancel, combine, reschedule, or discontinue a course when necessary. Material changes affecting an enrolled student will be addressed under the applicable enrollment agreement or academic policy.
SMA issues credit, transcripts, or diplomas only when the applicable academic, attendance, assessment, payment, and administrative requirements have been satisfied.
Acceptance and transfer of any SMA course, credit, transcript, or diploma are determined solely by the receiving school, district, college, university, athletic organization, employer, government authority, or other institution. SMA does not guarantee acceptance or transfer. Students and families should obtain written approval from the receiving institution before enrolling when transfer credit is required.
SMA may offer courses designed to prepare students for Advanced Placement examinations. The College Board administers AP examinations, and individual colleges and universities determine whether examination results qualify for credit or placement. Enrollment in or completion of an AP course does not itself guarantee college credit, placement, admission, or a particular AP examination score.
College Board, Advanced Placement, and AP are trademarks of the College Board. References to them do not imply sponsorship beyond any current authorization applicable to the relevant course.
SMA does not guarantee any particular grade, GPA increase, examination score, course placement, credit transfer, graduation, diploma acceptance, school or college admission, scholarship, athletic eligibility, employment outcome, or other result. Outcomes depend on student effort, attendance, participation, prior preparation, academic integrity, institutional requirements, and circumstances outside SMA’s control.
Testimonials, examples, statistics, and student stories describe individual experiences and do not guarantee similar results.
Students may not cheat, plagiarize, impersonate another student, submit work produced by another person, obtain unauthorized assistance, misuse artificial intelligence contrary to course policy, interfere with assessments, harass another participant, or disrupt a class or system. SMA may investigate suspected misconduct and apply consequences under its academic policies.
Group classes or live sessions may be recorded for instructional access, attendance, quality assurance, or academic administration. Participants will receive notice when a session is recorded. Recordings may contain participant names, images, voices, chats, shared screens, and class participation.
Recordings and class materials are for authorized educational use only. Users may not download, screen-record, copy, repost, distribute, publicly display, edit, or commercially use them without written authorization. SMA will obtain any separate authorization required before using a student’s image, voice, work, or testimonial in public marketing.
Users may not use the Services unlawfully; access another person’s account or records; introduce harmful code; interfere with security or operations; scrape or systematically extract content; harass others; submit infringing or harmful material; or copy, sell, publish, distribute, or create competing products from SMA content without permission.
The Services and their content, including curriculum, lessons, recordings, assessments, course materials, graphics, software, logos, and designs, are owned by SMA or used with permission and are protected by intellectual property law. SMA grants authorized users a limited, revocable, nonexclusive, nontransferable license to use assigned materials for personal educational purposes during authorized access. No other rights are granted.
Students retain ownership of original work they submit. They grant SMA a limited license to host, reproduce, evaluate, annotate, transmit, and retain that work as reasonably necessary to provide instruction, maintain academic records, verify integrity, comply with law and accreditation requirements, and administer the Services. Public marketing use requires any separate authorization required by law.
Our handling of personal information is described in our Privacy Policy. The Services may use third-party LMS, video, storage, payment, or communication providers. Their services may also be subject to their own terms and notices.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SMA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. SMA DOES NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, UNINTERRUPTED, OR ERROR-FREE. NOTHING IN THESE TERMS EXCLUDES RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMA, SINICA EDUCATION INC., AND THEIR OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE SERVICES.
For claims arising solely from Website or LMS use, total liability will not exceed the greater of the amount paid specifically for the affected online service during the six months before the event giving rise to the claim or one hundred U.S. dollars. This limitation does not replace different terms in a signed enrollment or service agreement and does not apply where prohibited by law.
These Terms are governed by California law, without regard to conflict-of-law principles. Subject to nonwaivable consumer protections, disputes arising from these Terms must be brought in the state or federal courts located in Los Angeles County, California. This section does not eliminate protections that cannot lawfully be waived.
We may update these Terms prospectively by posting a revised version and date. Additional notice will be provided when required. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and applicable enrollment and academic agreements form the agreement governing the matters they address.
